Advertisement Guidelines
This website/mobile application (Platform) is owned and operated by Eterno Infortech Private Limited (“Eterno”, for the purpose of this Policy, Eterno includes its subsidiaries, parent entities and sister concerns) and all rights related to the Platform vest in Eterno. The Platform facilitates and provide services for facilitation of publication and broadcast of advertisements on various mobile applications, websites and/ or platforms, including m.dailyhunt.in and Dailyhunt APP (com.eterno). Eterno is merely a service provider which provides access to the Platform and advertising services provided hereunder as an intermediary. If you wish to publish any advertisement or to run an advertisement campaign on any mobile application, website or any other platform, using the Platform or to utilise any service provided on the Platform, you are bound by the terms and conditions mentioned in this advertisement guidelines (“Guidelines”), along with our advertisement policy (“Policy”).
The objective of these Guidelines is to help you understand what can (or cannot) be promoted/advertised through the Platform and what should be the content of the advertisement published on any mobile application, website or platform, through the Platform or through any service provided therein. These Guidelines provides certain categories of the prohibited and restrictive advertisement, content, products and/or services which shall not be published, promoted or endorsed through the Platform. The categories provided in these Guidelines shall neither be deemed/considered as an exhaustive list of all regulated categories of advertisement, product or services, nor as an exhaustive list of each regulation related to any single category of advertisement, product or services.
Eterno may, any time, review these Guidelines in light of emerging advertising trends, methods, and regulations, user preference, and of other operational considerations. Eterno reserves the right to modify, amend or change these Guidelines or any part thereof, any time, without giving any explicit notice to you and such changes, modification or amendment in the Guidelines will be enforceable for the date of their publication on the Platform. It is recommended that you should from time to time check for any update or modification in the Guidelines.
Notwithstanding anything mentioned in these Guidelines, Eterno reserves the right to remove or block any advertisement or content for any reason, without giving any prior notice to you, at its sole discretion, either before of after the publication of the advertisement.
If you disagree with any terms or conditions of these Guidelines, you are no longer authorized to publish, broadcast or communicate to public any advertisement using this Platform or to utilise any service provided on this Platform
For purpose of this Guidelines, advertisements shall have a same meaning as defined under the Policy.
Compliance with the Guidelines
It is your responsibility to ensure that your advertisements and any content therein comply with all applicable laws, norms, rules, and regulations, the Policy, the Guidelines, and any other instructions provided to you by Eterno.
Although these Guidelines provide certain legal requirements applicable on certain categories of advertisements, you should not consider these Guidelines as an exhaustive list of rules and/or regulations applicable on you while publishing or broadcasting any advertisement of any category. In addition to the terms of these Guidelines, based on your location, category of the advertisement, target audience or any other factor, you may be bound by other laws, norms, rules and/or regulations while developing, submitting or publishing any advertisement. It is hereby recommended that you consult a legal counsel regarding appropriate advertisement practices in your industry and location and laws governing your publication of advertisement and content therein.
Prohibited Categories
Eterno takes all the reasonably necessary steps to ensure that the advertisements published through the Platform or through any service provided therein are appropriate, relevant and not in violation of any laws. Eterno also takes steps to ensure that the advertisements published through the Platform or through any service provided therein, do not promote any inappropriate products/services, which are prohibited by law.
Your advertisement must comply with the terms and conditions provided below. Publication of any advertisement which violates any of the following conditions is strictly prohibited. Your use of the Platform or any services provided therein for publication or broadcast of any advertisement which directly or through its contents, is inconsistent with any of the following conditions, may give rise to criminal or civil action against you, along with denial of access to the Platform or to services provided therein.
Content of your advertisement must be accurate and must clearly define the product, services or brand promoted, and source of the advertisements. Landing page of your advertisement must contain the same product, service or brand contained in the advertisement. More information regarding landing page of the advertisement is defined later in these Guidelines.
If your advertisement contains an image, it is your responsibility to ensure that the image is clear, recognisable, properly oriented and of good quality. You must also ensure that the image in your advertisement must be linked to the content of and/or product/services promoted in your advertisement.
Your Advertisement shall not, in any manner, adversely effect competition in your market. You are not authorised to make any comments about or references to competitors’ products or services in your advertisement.
Your advertisement must not, directly or indirectly, disseminate any obscene, offensive or inappropriate content. Your advertisement must not depict nudity, intolerant or overly contentious political or cultural topics or views, vulgar or sexually explicit words or images, people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative.
Your advertisement must not, directly or indirectly, contain any shocking, scandalous, disrespectful or violent image, text or graphic. Your advertisement must also not contain any content that is based on social or political issues or controversies, or exploit such issues or controversies for commercial or financial benefit.
Your advertisement must not contain any content which, directly or indirectly, discriminates or encourages discrimination among people based on personal attributes such as race, nationality, gender, cast, religion, sexual orientation, age, disability or financial or social status.
Your advertisement must not contain any content which, directly or indirectly, infringes or violates any rights of any third party, including intellectual property rights, publicity rights, privacy rights or any other rights.
You are not authorised to use or incorporate Eterno’s intellectual property in your advertisement, without prior written consent of Eterno.
Your advertisement must not defame or otherwise lower the reputation of any individual, group, organisation, religion, profession or entity.
Your advertisement or any content therein must not promote any trade or business activity which is inconsistent with the trade policies of the country/region in which the advertisement is to be published or broadcasted.
Your advertisement or landing page of your advertisement must not contain any content which is in itself false, misleading or fraudulent, makes false or misleading promises or claims or is based on false assumptions.
Your advertisement must not, directly or indirectly, demonstrate or depict unlikely or unexpected results, such as making major financial gain in short span of time with little investment, losing weight with no diet or exercise, or solving financial, social or political problems with the help of any product which is not related to such problem or its solution.
Content of your advertisement must be grammatically correct and should be properly punctuated. You should not employ any technique, tactic or technology to circumvent or evade any advertisement review and enforcement process.
Your advertisement must not contain malware, spyware or any other software which results in an unexpected or disruptive experience or denies access to any computer system or network. Your advertisement must not be linked to any landing page containing such malware, spyware or software.
In addition to the prohibited categories mentioned above, any advertisement published through the Platform or through any service provided therein must not facilitate, promote or endorse any activities, products or services which fall under any of the following categories. Promotion, endorsement or facilitation of any activity, service or product which falls under any of the following category may give rise to criminal or civil action against you, along with denial of access to the Platform or to services provided therein.
Your advertisement must not facilitate, promote or endorse any activities, products or services which are illegal and/or sales or distribution of which is expressly prohibited by any applicable law.
Your advertisement must not promote or endorse activities, products or services that facilitate or encourage illegal, immoral, fraudulent or misleading behaviour. Your advertisement must not promote or endorse any unlawful, improbable, or unsubstantiated financial products and services, investments, or contribution strategies and schemes.
Your advertisement must also not promote any products or services which facilitate or encourage unauthorised download or online streaming of or otherwise grant unauthorised access to digital media or any other content.
Your advertisement must not promote or endorse any products which are counterfeit or pirated. Your advertisement must not promote or endorse any product with marks or logos that falsely denote the source of the products or are likely to confuse customers regarding the source of the products.
Your advertisement must also not promote or endorse any non-authentic collectibles and must not in any manner mislead the consumers regarding the year or place of manufacturing, or previous utilisation of any product.
Your advertisement must not promote or endorse false documents, false or fake identity cards issued by government or public authority or fake marksheet or degrees.
Your advertisement must not promote or endorse any products or services which are injurious to health or are likely to have an adverse effect on the health of any person consuming them. For example;
Your advertisement must not endorse or promote any hazardous, dangerous or injurious products or services, such as explosive materials, fireworks, weapons, ammunitions, weapon accessories, etc.
Your advertisement must also not endorse or promote spy cameras, mobile phone tracker or any other surveillance or spying device or software.
Your advertisement must not promote or endorse adult products or services, except products or services for family planning and contraception. Advertisement of contraceptive products must only focus on its contraceptive property and not on sexual pleasure. Advertisements for such contraceptive products must not feature minors, and must only be targeted to adults.
Your advertisement must not promote or endorse sale of live animals, birds or insects. However, advertisements relating to free pet adoption are allowed.
Restrictive Categories
Eterno imposes certain restriction and/or condition for publication of certain categories of advertisements. While publishing any advertisement, falling under any category provided below, through the Platform or through any service provided therein, it is your responsibility to make sure that all the conditions mentioned in the category are satisfied, along with any laws, rules or regulations that deals with such categories of advertisement or product/service.
While promoting health, pharmaceutical or beauty products or services, you must ensure that your advertisement shall not:
You are only authorised to promote or endorse health, pharmaceutical or beauty product or service if such product or service has obtained all the necessary approvals from government agencies.
Advertisement relating to online dating services or platforms must be published through the Platform or services provided therein, only after prior written approval of Eterno. You may launch a request for such approval via an email at Yourfriends@Dailyhunt.in, with the subject “Requesting Approval”. Upon obtaining an approval from Eterno, you must ensure that your advertisement does not:
Eterno takes violation of any third-party rights on or through its platforms very seriously. If your advertisement includes any third-party product, mark or content, you must ensure that you have taken all the necessary permission from that third party for utilising or incorporating its content, mark or product in your advertisement. Eterno may ask you to submit documentary proof of your right to incorporate third-party content, mark or product in your advertisement.
Advertisement promoting or endorsing gambling, betting or services related to gambling or betting, involving real money or property, can be published through the Platform or through any service provided therein, only after prior written approval of Eterno. You may launch a request for such approval via an email at Yourfriends@Dailyhunt.in, with the subject “Requesting approval”. While publishing any advertisement falling under this category, you must ensure that such advertisement shall not be targeted to any person below the age of 18 years.
Any advertisement or communication relating to political issues, election campaigns or any commitments made by political candidates, may be published only after prior written approval of Eterno. You may launch a request for such approval via an email at Yourfriends@Dailyhunt.in, with the subject “Requesting approval”. While publishing any advertisement falling under this category, you must ensure that:
Advertisements relating to financial services must clearly disclose all applicable fees and approvals or certification from appropriate regulatory authority.
Advertisements promoting or endorsing sales, management of or investment in cryptocurrency may only be done after prior written approval of Eterno. You may launch a request for such approval via an email at Yourfriends@Dailyhunt.in, with a subject “Requesting approval”. While publishing any advertisements relating to cryptocurrency, you must ensure that such advertisement shall not be targeted to any person below the age of 18 years.
Video Advertisement
While publishing video advertisement through the Platform or through any service provided therein, you are required to ensure that your advertisement or any content contained therein is in accordance with the terms mentioned hereunder, along with all other terms of these Guidelines.
Landing Page Guidelines
While linking your advertisement to a landing page or to a specific URL, it is your responsibility to ensure:
Non-compliance with these Guidelines
If your advertisement or its landing page does not comply with any of the terms mentioned in these Guidelines then, Eterno may, in its sole discretion:
If Eterno takes any action, mentioned under point number 1, 2, 3 and 4, against you, your sole remedy will be to request reinstatement/acceptance of your advertisement or reactivation of your account. You may make such request via email at Yourfriends@Dailyhunt.in, with the subject “Requesting reinstatement”.
You acknowledge, agree and confirm that, if Eterno takes any action, mentioned under point number 5 and 6, against you, you will be liable to defend such action at your own cost and consequence.
